בית המשפט העליון כב' הנשיאה חיות דחה את בקשת רשות הערעור על החלטת בית הדין הצבאי לערעורים  החלטה שעניינה פרשנות תקנה 28ב לתקנות תעבורה לעיניין השימוש בטלפון. [למרות שמכשיר הסלולאר היה קבוע בדיבורית הערה שלי א.ח.]

נקבע ש :

בית המשפט העליון אמץ את החלטת בית המשפט הצבאי לערעורים לפיו " נהג המחזיק את הטלפון בשני צדיו אף אם אינה "אחיזה" אופיינית, מתיישבת עם המשמעות המילולית של המונח "אחיזה"ועם לשון התקנה שאוסרת על כל אחיזה בטלפון באשר היא....

תכלית התקנה היא למנוע הסרת יד מההגה מעבר להכרח ובפרט למנוע הסחת דעת שיכולה להתלוות לאחיזה בטלפון הנייד במהלך נהיגה. בענייננו, צוין כי המבקש הותיר את אצבעותיו על שני צדי הטלפון משך שניות ארוכות והדבר עלול היה להוביל להסחת דעת.

"שימוש" בטלפון כמובנו בתקנה 28(ב), הוא שימוש המוגבל לנגיעה קצרה או רגעית בטלפון ואינו כולל פעולות ממושכות שעלולות להוביל להסחת דעת (לדוגמה איתור איש קשר בספר טלפונים, קריאה ושליחת הודעות sms ועוד) 


בסיום מוצאת כב' הנשיאה לפנות למחוקק ללעשות לתיקון/הבהרת  התקנה  "  טרם סיום, ראיתי להעיר עם זאת כי מאז שתוקנה תקנה 28(ב), לפני כ-15 שנים בקירוב, התעוררו לא אחת שאלות פרשניות בדבר היקף השימוש המותר מכוחה של התקנה ובאשר למדיניות אכיפתה. בשים לב לכך שאופן השימוש במכשירים ניידים השתנה באופן ניכר לאורך השנים האחרונות, מן הראוי כי מחוקק המשנה ורשויות האכיפה המוסמכות ישובו ויבחנו את הצורך בתיקון נוסף או בהבהרה של התקנה (על הקושי הפרשני שעוררה התקנה בנוסחה הקודם והצורך בתיקונה אז ראו: רע"פ 6359/06 בשותי נ' מדינת ישראל [פורסם בנבו] (3.5.2007)).
